Terms & Conditions

1. About these terms and us
-
-
These terms govern your use of this website and any purchase you make directly from us through it. Please read them before placing an order.
-
The website is operated by The Hawkstone Farmers’ Choir Ltd (“we”, “us” and “our”), a company registered in England and Wales under company number 17296762. Our registered office is 101 New Cavendish Streeet, 1st Floor South, London, United Kingdom, W1W 6XH. You can contact us at enquiries@thehawkstonefarmerschoir.com.
-
If you buy from another business after following a link on our website, your contract for that purchase is with the business identified during its checkout, unless it clearly states otherwise. Its terms will apply to that purchase.
-
These terms do not affect your statutory rights. If a provision in these terms conflicts with a right you have under applicable consumer law, that right takes precedence.
-
2. Using this website
-
-
You may use this website for lawful, personal purposes. You must not misuse it, interfere with its operation, attempt to gain unauthorised access to it, or use its content in a way that infringes another person’s rights.
-
We take reasonable care over the information on the website. Information about products, performances and availability may nevertheless change. Please check the final details presented before you place an order or make travel arrangements.
-
We may update, suspend or withdraw parts of the website where reasonably necessary. We cannot guarantee uninterrupted access to it.
-
3. Performances and ticket links
-
-
The website may display tour dates and link to external ticket sellers. A link does not, by itself, mean that we are selling the ticket. Before paying, check who the seller is, the event details, the total price and the seller’s terms. Questions about a booking made with an external seller, including refunds and ticket delivery, should be directed to that seller.
-
Performance details may change. The ticket seller’s booking information and any notice from the venue or event organiser should be checked before you travel.
-
If we offer tickets for sale directly through this website, the event description and any event-specific conditions shown before payment will form part of your contract with us. We will identify any age restrictions, entry requirements and material conditions before you buy.
-
Where we sell a ticket directly for a performance on a specified date or during a specified period, the usual 14-day change-of-mind cancellation right does not apply. This does not remove any rights you may have if the event is cancelled, materially changed or not provided as agreed.
-
If we sell you a ticket directly and cancel the event, we will offer a refund of the amount you paid us for that ticket, including any compulsory booking charge we collected. If we postpone or materially change the event, we will tell you the options available, which may include using the ticket for the new event or requesting a refund. Your legal rights remain unaffected.
-
4. Goods and digital content sold directly by us
-
-
If we offer goods or digital content for direct purchase, their main characteristics, price, applicable taxes, available delivery or access methods, charges and any restrictions will be shown before you place your order. The information shown at checkout forms part of your contract with us.
-
You must provide accurate order and contact details. You will have an opportunity to review and correct your order before submitting it. Placing an order is an offer to buy. We will acknowledge receipt by email, but that acknowledgement does not mean we have accepted the order.
-
We accept an order when we send an order confirmation expressly accepting it or, for goods, when we dispatch them, whichever happens first. We may decline an order where, for example, an item is unavailable, a price or description contains an obvious error, we cannot authorise payment, or we cannot deliver to the address supplied. If we decline an order after taking payment, we will refund that payment.
-
Prices and delivery charges are those displayed at checkout when you order. We may change prices for future orders, but will not change the agreed price of an order we have accepted. Payment methods will be displayed at checkout. We will not add an optional paid extra without your express agreement.
-
5. Delivery of goods
-
-
We will show available delivery destinations, options, charges and estimated times before you order. We will deliver to the address you provide. Please contact us promptly if you discover an error in that address.
-
We will deliver within the period agreed at checkout or, if no period is agreed, without undue delay and no later than 30 days after the contract is made, unless the law permits otherwise. If we cannot meet an agreed delivery date, we will contact you and explain your options.
-
Goods become your responsibility when you, or someone you identify to receive them, takes physical possession of them. You own the goods once we have received payment in full and they have been delivered.
-
If we offer delivery outside the UK, any customs charges, import taxes or restrictions that you must pay or observe will be made clear where applicable before purchase. The available destinations and terms for a particular order will be shown at checkout.
-
6. Your right to cancel a direct purchase
Goods
-
For most goods bought directly from us online, you may cancel without giving a reason from the time you place your order until 14 days after you, or someone you nominate, receives the goods. If goods in one order arrive separately, the period runs from receipt of the last item.
-
To cancel, email enquiries@thehawkstonefarmerschoir.com with a clear statement that you wish to cancel. Include your name and order number if available. You may use the cancellation form at the end of these terms, but you do not have to.
-
After telling us you wish to cancel, we will share an address which you must send the goods back within 14 days.
-
You must pay the direct cost of returning goods unless we have agreed to pay it or the goods are faulty, incorrect or not as described. We recommend obtaining proof of postage.
-
We will refund the price paid and the cost of our least expensive standard delivery option. We will use the original payment method unless you agree otherwise. We may wait until we receive the goods back or you provide evidence of having sent them, whichever is earlier. We will then make the refund within 14 days. We may make a deduction for any reduction in value caused by handling beyond what is necessary to establish the goods’ nature, characteristics and functioning.
-
The change-of-mind right does not apply where the law provides an exception, including goods made to your specifications or clearly personalised, and sealed goods unsuitable for return for health or hygiene reasons once unsealed. Where an exception applies to a product, we will make this clear before you buy. Your rights if the product is faulty or misdescribed still apply.
Digital content
-
Where digital content is not supplied on a physical medium, you ordinarily have 14 days from entering the contract to cancel. If you ask us to begin supplying it during that period and expressly acknowledge that doing so will cause you to lose your cancellation right, that right will end when supply begins. We will seek that agreement and acknowledgement separately at checkout where applicable.
7. Problems with a direct purchase
-
-
We are responsible for ensuring that goods and digital content we sell directly meet the standards required by law. If something is faulty, damaged, not as described or has not been supplied as agreed, email enquiries@thehawkstonefarmerschoir.com with your order details and a description of the problem.
-
Depending on the circumstances, you may be entitled to a refund, repair, replacement or other remedy under the Consumer Rights Act 2015. These rights apply in addition to any change-of-mind cancellation right and are not limited by the exclusions in section 6.5.
-
If we ask you to return faulty or incorrect goods, we will cover reasonable return costs. Please contact us before sending them so we can arrange the return.
-
8. Promotions
-
-
Any competition, discount or promotion may have additional terms shown with that offer. If those terms conflict with these terms on a matter specific to the promotion, the promotion terms will apply to that matter. We will not use a promotion to remove your statutory rights.
-
9. Intellectual property
-
-
The website and its content, including names, branding, text, images, recordings and designs, are owned by us or used with permission.
-
You must not reproduce, sell, commercially exploit or falsely present our content or branding as your own without permission from the relevant rights holder. You may share links to publicly accessible pages of the website.
-
10. Other websites and services
-
-
Links to external websites are provided for convenience. We do not control their content, availability, security or terms. This includes ticketing, payment and social media websites operated by others.
-
Where another business is the seller, payment processor or service provider, we will identify its role where relevant. Nothing in this section limits our responsibility for a purchase where we are the seller.
-
11. Our responsibility to you
-
-
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it was obvious it might happen or both you and we knew it might happen when the contract was made.
-
We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights in relation to goods, digital content or services.
-
This website and our direct sales are intended for consumers. We are not responsible for business losses, such as lost profit or business interruption, arising from a consumer purchase or ordinary use of the website.
-
12. Privacy
-
-
Our Privacy Notice explains how we collect and use personal information. Information about cookies and similar technologies should also be provided in our cookie information and, where required, through the website’s cookie controls.
-
13. Changes to these terms
-
-
We may change these terms from time to time by publishing an updated version and date on the website. The terms in force when we accept your order will continue to govern that order. We will not retrospectively change an accepted order without your agreement.’
-
14. General
-
-
If a court finds part of these terms unenforceable, the remaining parts will continue to apply.
-
A delay in enforcing a right does not mean we have given it up.
-
No person other than you and us has a right to enforce a contract between you and us, except where the law provides otherwise.
-
These terms are governed by the law of England and Wales. If you are a consumer resident elsewhere, you retain the protection of any mandatory consumer laws that apply where you live. You may bring proceedings in the courts of England and Wales or, where applicable law permits, in the courts where you live.
-
16. Contact and complaints
-
-
For questions, cancellations or complaints, email enquiries@thehawkstonefarmerschoir.com. Please include your order or booking reference where relevant. We will acknowledge your message and work with you to resolve the issue.
-
For tickets bought from an external seller, please contact the seller named in your booking confirmation about the purchase itself. You may still contact us about information published on our website or a performance we organise.
-
